行政强制设定后评估制度研究-《南京师大学报》（社会科学版）

摘要:: 行政强制设定后评估制度是行政强制设定制度中一个相对微小的制度环节，但是对于行政强制法的实现来讲却是非常必要而且有价值的。以我国《行政强制法》的立法技术来观察，在行政强制设定中确立有关行政强制设定后评估制度具有非常大的制度创新性，这一制度某种意义上来讲拓展了我国立法制度中的制度特性，当然更为重要的是它有效地保证了行政强制设定的规范化。本文对行政强制设定后评估制度的制度属性、立法理由、评估指标和程序规则作了较为系统的探讨，试图从行政程序法治视角为行政强制设定后评估制度的实施、规范和完善提供参考。

Abstract:: The evaluation of the administrative compulsion, though a relatively minor link in the system of setting administrative compulsion, is essential to implementing the Administrative Compulsion Law. In terms of the legislative technology, it is innovative to establish an evaluation system for the creation of administrative compulsion. This does not only manifest the institutional character of Chinas legislative system, but effectively guarantees the standardization of the creation of administrative compulsion as well. The nature, legislative reason, evaluation quota and the procedural rules of the evaluation system are discussed in this paper, which is intended to provide a reference for the implementation, standardization and perfection of the said system.
