摘要:
《中华人民共和国家庭教育促进法》是一部调动全社会力量共同做好家庭教育工作的促进型法律。该法的立法宗旨是:落实党和国家对家庭建设与新时代儿童成长的高度关切,在国家法律层面上规定了新时代家庭对儿童成长的责任,全社会协同构建新时代优质家庭教育指导服务体系。该法为实施家庭教育指导提供了专项法依据,其法律内涵体现于:促进型法律,体现出国家对家庭教育指导的纲领性要求; 规范性要求,进一步明确了家长在新时代儿童成长中的责任; 使命型担当,强化政府在家庭教育指导与服务中的公益性责任; 协同性推进,确立全社会共同支持家庭教育的责任要求。要通过创新学习贯彻方式、增强研究与实践的合作、完善约束与激励制度、强化政府责任等方式高质量实施《家庭教育促进法》。
Abstract:
The Family Education Promotion Law of the People’s Republic of China is a law to mobilize the whole society to carry out family education. Its legislative purpose is reflected in the following aspects: to put into effect the policy of the Communist Party of China and the State to promote family construction and children’s growth in the new era; to define the responsibility of the family in the form of national law for ensuring the sound growth of children in the new era; and to unite the whole society to build a high-quality family education guidance and service system in the new era. This law provides a special legal basis for the implementation of family education guidance. Its legal connotation is as follows: the law with a promotive purpose reflects the programmatic requirements of family education service; its normative requirements clarify the responsibilities of parents for the growth of their children; its mission-oriented responsibility requires the government to ensure the public welfare of family education; and the collaborative governance it requires establishes the responsibility of each subject to support family construction. In order to implement this high-quality law, we should innovate the way of study and implementation, strengthen the cooperation between research and practice, improve the restraint and incentive systems, and strengthen the government’s accountability.
