“错法”系难以服务于经济社会发展大计、脱离生产生活实际或者违背社会主流价值的法。“错法”现象在经济法领域尤为严重。经济法中的“错法”缘于经济关系复杂多变,主观的法律规范未能适当地反映客观的规律和要求,而难以与社会中的经济系统和非经济系统有效地沟通和互动。由于具体错因不同,错法有多种类型。面对经济法中的“错法”,可以用法律评估、民主立法、问责制和违宪审查等方法来发现并改正它。

Outdated legislations refer to those failing to meet the needs of economic and social development, losing contact with reality, or going against the mainstream values in our society. They are commonly seen in the field of economic law. Due to complex economic relations, economic law does not always meet our realistic needs, leading to an inefficient interaction with economic and non-economic systems in our society. Outdated laws fall into several types according to different causes for their obsolescence. As to outdated legislations in the field of economic law, we can identify and correct them through introducing legal assessment, democratic legislation, accountability system and judicial review.
