论哈特法哲学理论的语言学方法与反科学主义意蕴 ——基于维特根斯坦语言哲学的诠释-《南京师大学报》（社会科学版）

摘要:: 后期维特根斯坦的语言哲学与哈特的法哲学理论有着众多交会之处,是理解哈特法哲学理论的核心。因此,在考察哈特与维特根斯坦思想脉络关联的基础上,运用维特根斯坦后期思想中的“语言游戏”说,从“语境原则”和“语言游戏”多样性的两个方面对哈特法哲学理论关于法律陈述方面的论述进行维特根斯坦式解读,对于理解哈特法哲学理论并进而准确把握其法律的内、外陈述的意义以及理解其法哲学理论背后的反科学主义的哲学意蕴,在日常生活法律语言运用方面具有十分重要的理论意义与现实启示。

Abstract:: Hart’s legal philosophy has many contacts with the philosophy of language of later Wittgenstein. This is a key to the understanding of Hart’s legal theory. Therefore, based on the investigation of the relation between Hart’s thought and Wittgenstein’s, the author makes a Wittgensteinian reading of Hart’s legal theory from two aspects of Wittgenstein’s thought on “language game”, i.e., “context principle” and the diversity of language game. This reading will facilitate the understanding of Hart’s legal theory, especially his thought on the internal and external statements in law and the philosophical implication of anti-scientism of Hart’s legal theory, which is of great theoretical significance and practical value in the operation of legal language in ordinary life.
